DWI/DUI Defense & Other Municipal Court Violations
Driving While Intoxicated is a serious offense. A first time conviction will result in a driver’s license suspension for seven months and thousands of dollars in fines and surcharges. A second conviction imposes a two year loss of license. A third offense will result in a ten year loss of license and a mandatory 180 day jail sentence. Conviction of a Refusal to a Breath Test will also result in a suspension of your license.
A DWI violation cannot be plea bargained to a lesser offense. If you are convicted of DWI, your license will be suspended. You will not be permitted to drive for any reason. There is no provisional license to drive to work while the suspension is in effect.
DWI cases are difficult. However, there are defenses available to you that can result in a shorter suspension or a dismissal. It is important to have an attorney that is experienced in DWI cases review the state’s evidence to determine what defenses are applicable to your case. In all DWI matters, we meet with the client to discuss the facts and circumstances of motor vehicle stop. We obtain the Alcotest results, the Alcotest machine’s maintenance records and the operator’s certification. We review the police video from the motor vehicle stop as well as the police report and records. After we have reviewed all of the state’s evidence, we will discuss with you our best course of action.
