Driving While Intoxicated is a serious offense. A first time conviction will result in a driver’s license suspension for seven months and thousands of dollars in fines and surcharges. A second conviction imposes a two year loss of license. A third offense will result in a ten year loss of license and a mandatory 180 day jail sentence. Conviction of a Refusal to a Breath Test will also result in a suspension of your license.

A DWI violation cannot be plea bargained to a lesser offense. If you are convicted of DWI, your license will be suspended. You will not be permitted to drive for any reason. There is no provisional license to drive to work while the suspension is in effect.

DWI cases are difficult. However, there are defenses available to you that can result in a shorter suspension or a dismissal. The penalties for these offenses include suspension of your driver’s license, heavy fines, insurance points and, in some circumstances, jail sentences. Our procedure defending these violations is the same as in DWI cases. We obtain and review the police report, police records and video of the motor vehicle stop. Before trial, we will meet with the prosecutor to discuss the dismissal of your violations or a plea to a lesser offense that avoids insurance points and minimalizes the penalties,.
